Rental Agreement Terms

Late Fees

If the UTV or trailer is returned past the agreed-upon time, a late fee will be charged. The late fee is $50.00 for the first 30 minutes and $100 for up to one hour. For each additional hour, a late fee will be charged in addition to the rental charges. Please note that no exceptions will be made, and early returns will not be credited.

Excessive Mud and Trash Fee

The renter is responsible for returning the UTV in a reasonably clean condition. If the UTV is returned with excessive mud or trash, a cleaning fee of $75.00 may be charged. Please make sure to clean the UTV before returning it to avoid any additional charges.

Damages

The renter is responsible for any damages to the UTV during the rental period. All riders must sign the rental agreement before renting a UTV. If the UTV is damaged, the renter will be required to pay for the damages, including the deposit, upon return of the rental. Additional fees may be charged for damages that are not immediately noticeable, loss of use of up to 14 days, fuel, cleaning, abuse, and late returns. Please take care when operating the rental equipment to avoid any additional charges.

Deposit

At the time of signing this rental agreement, the renter must pay a security deposit of $1,000 for each UTV rented. Only valid debit or credit cards will be accepted for this deposit. This deposit will be refunded to the renter upon the termination of the rental agreement, minus any expenses incurred to retrieve the UTV or repair any damage caused during the rental period by the renter or anyone else. If the renter is paying by a non-debit credit card, a security deposit of $1,000 will be charged immediately if the UTV comes back with any damage. In the event of an incident requiring repairs, we reserve the right to hold the deposit until all necessary repairs are completed. Once finalized, we will promptly return the remaining balance via wire transfer to the contract holder. Please note, any applicable bank fees will be added to the final amount. We appreciate your understanding and cooperation.

Equipment Condition

The renter, who must be at least 21 years old, confirms that they have thoroughly inspected the UTV and found it to be suitable for the intended purpose. The renter also acknowledges that any accessory equipment provided with the UTV is in good condition and acceptable. The renter agrees to maintain both the UTV and equipment in a safe and reliable condition while they are in their custody.

Break Down/Malfunction

If the UTV experiences a malfunction or breakdown, or if any defect is discovered after accepting the rental, the renter will be held fully responsible for the UTV. The renter must report any such issues immediately to Jungle Monster Side-by-Side. It is at the renter’s sole risk to continue using the rental UTV after any issue is discovered.

Safety

The renter acknowledges their responsibility for safe and proper operation of the UTV, and for the safety of other operators and individuals. The renter certifies that they understand the rules and regulations related to UTV operation. In the event of any malfunction or breakdown, the renter agrees to immediately report it to Jungle Monster Rentals. Jungle Monster Side-by-Side shall not be held responsible for any damages, inconvenience, or time lost due to accidents, breakdowns, or malfunctions of the UTV during the rental period.

Health

The renter acknowledges and certifies that they are in good physical and mental health, without any physical defects that may pose a danger to themselves or others, and possess the capability to safely operate the UTV. Additionally, the renter certifies that they are not under the influence of any substance, including but not limited to alcohol or drugs (legal or illegal), and will maintain sobriety throughout the rental period.

Hold Harmless

The renter agrees to indemnify and hold Kreative Klein/Jungle Monster harmless from any claims for loss or damage to property or injury to persons, including death, resulting from the use, operation, or possession of the rented UTV. The renter also agrees to hold Kreative Klein/Jungle Monster harmless in the event of any loss or damages to the renter’s personal property while carried on the UTV or trailer, including losses or damages resulting from malfunction or theft.

Driving Access/Limitations

The renter is responsible for taking absolute care of the vehicle, ensuring it is only driven on suitable roads and under appropriate conditions based on the type of vehicle being rented. The vehicle must not be taken through rivers or exposed to saltwater, estuaries, or deep mud. The renter must not engage in intentional, reckless conduct or neglect. It is the renter’s responsibility to exercise reasonable caution while operating the vehicle, ensuring safety for themselves, others, the equipment, and the environment, while complying with applicable motor vehicle laws in Costa Rica.

Risk of Loss or Damage

The renter accepts all responsibility for any damage or loss to the UTV for any reason and commits to returning it to Jungle Monster in the same condition as received, except for normal wear and tear. The renter agrees to return the UTV by the end of the rental period in its current state.

Covenant Not to Sue, Liability, and Indemnity

The renter acknowledges and agrees to release and discharge Kreative Klein/Jungle Monster, its owners, employees, agents, and assigns from all claims, costs, damages, expenses, actions, judgments, and attorney fees. The renter agrees to indemnify and hold harmless Kreative Klein/Jungle Monster from any claims, damages, or liabilities arising during the rental period.

Dispute Resolution

We strive to ensure a smooth and pleasant experience for all our customers. In the unlikely event of any disagreements or disputes, we encourage open communication to resolve the matter amicably. If a resolution cannot be reached through discussion, the final decision will be made by Kreative Klein/Jungle Monster, and we kindly ask that this decision be accepted as final.
